Can you build over a ground stump?
No, not under anything with a foundation, a slab, a drainfield or a pool shell. Florida’s residential code requires stumps and dead roots removed from the foundation area and fill that is free of vegetation and compacted. A stump ground 4 to 6 inches down is a lawn fix, not a building-pad fix. Grass, pasture and landscaping are the only places a ground stump is fine.
That is the rule. The rest of this guide covers the code sections behind it, why a buried stump sinks, what a properly prepared pad looks like where a tree stood, and how Panhandle soil changes the details. What does the Florida Building Code say about stumps under a house?
The 2023 Florida Building Code, Residential edition, says it three ways. Section R506.2 on slab site preparation: “The area within the foundation walls shall have all vegetation, top soil and foreign material removed.” Section R506.2.1 on fill: “Fill material shall be free of vegetation and foreign material. The fill shall be compacted to ensure uniform support of the slab, and except where approved, the fill depths shall not exceed 24 inches for clean sand or gravel and 8 inches for earth.”
The termite chapter is the most direct. Section R318.6.2: “The foundation and the area encompassed within 1 foot therein shall have all vegetation, stumps, dead roots, cardboard, trash and foreign material removed and the fill material shall be free of vegetation and foreign material. The fill shall be compacted to assure adequate support of the foundation.” Footings, under R403.1, sit “on undisturbed natural soils or engineered fill.” Commercial buildings follow the same idea in the Florida Building Code’s soils chapter, which requires backfill “free of organic material, construction debris, cobbles and boulders.”
Read together, those sections rule out a ground stump under any part of a house. A stump ground flush is still a stump. Grindings left in the hole are vegetation. A 3-foot crater backfilled with loose sand exceeds the 24-inch fill limit unless an engineer approves it. And the termite pretreatment has to go down after all excavation, backfilling and compaction are done, so any stump pulled later means treating the soil again.
Why does a buried stump cause settlement?
Because wood rots and soil does not. A stump and its root plate take up real volume underground. As the wood decays it collapses inward, and the soil above drops into the space. Contractors and forensic engineers put the typical window at five to fifteen years, which is why a slab can look fine at closing and crack after the second owner moves in. The damage shows up as a circular sunken spot or a crack directly over where the tree stood.
The clock runs longer than people expect. A U.S. Forest Service study of loblolly pine roots in the Southeast found more than half the root mass decomposed in the first ten years, but large lateral roots persisted for more than 35 years and taproots for more than 60. Longleaf pine, the Panhandle’s native pine, holds its coarse roots even longer. So the void does not open once. It keeps opening, in stages, for decades.
Sand makes the failure sudden. Highway engineers note that sandy soils settle immediately under load rather than creeping the way clay does. On the deep Lakeland and Troup sands that cover most of Santa Rosa and Escambia counties, a collapsing stump void shows up as an abrupt dip or crack, not a slow lean.
Then there are termites. Native subterranean termites live in dead trees and rotting wood, run colonies of 100,000 to a million, forage up to 150 feet, and enter a house through foundation cracks. The Formosan termite, established across Florida, runs colonies of several million and infests living trees. Florida’s code strips wood from the pad before the soil is pretreated for exactly this reason, and Mississippi State’s extension service says it plainly: remove any tree stumps and roots during initial site preparation.
How is a building pad prepared where a tree stood?
The word for it is grubbing. Clearing takes the vegetation off the surface. Grubbing takes the stumps and roots out of the ground. Santa Rosa County’s own land development code folds it into major land clearing, “including stump removal, root raking, excavation, filling or grading of land.”
On a pad the sequence is fixed:
- Excavate the stump and its root ball with the excavator, and pull the large lateral roots with a root rake or grapple.
- Take the organic material out of the crater. Topsoil goes too. Structural fill specs commonly cap organic content at 1 percent by weight.
- Backfill with clean fill in lifts of 6 to 12 inches, compacting each lift before the next goes on.
- Compact and test. Florida building departments commonly require fill under a foundation compacted to 95 percent of its maximum dry density under the Modified Proctor standard, checked with a nuclear density gauge or a sand cone test before concrete is poured.
- Pretreat the soil for termites, lay the vapor retarder, and pour.
The 24-inch fill cap is the reason a deep stump crater is a bigger job than a shallow one. Anything deeper than 24 inches of sand or gravel needs approved, engineered fill with testing to back it up. That is not a reason to leave the stump. It is the reason to price the pad as a pad.

Septic is the one people miss. Florida’s onsite sewage rule requires any fill used in the system to be “free of extraneous non-soil material such as grass, roots and any other debris,” and fill either settles for at least six months or gets compacted to the density of the surrounding soil. No driveway or concrete can cover the drainfield, and trees cannot obstruct it. A rotting stump inside the absorption area is an obstruction today and a void later, so the installer will want it out even though no rule names stumps by word.
What does Panhandle ground do to the answer?
The soil under the pad changes the details, not the rule. The NRCS soil maps put Jay on Red Bay sandy loam, a well-drained loamy soil that holds a pad well and gives up a root ball with a plug of clay attached. Milton and Pensacola sit on Lakeland sand, sand to more than 80 inches deep and excessively drained. Pace sits on Troup loamy sand. Those sands compact easily but settle the moment a void opens, and they slough into a stump crater unless the backfill is wetted and tamped in lifts.
Navarre and the flatwoods south of Milton are the different case. Leon sand there holds a wet-season water table within inches of the surface. Pads get built up with imported fill, which is why the 24-inch fill limit and the density test matter so much on that side of the county. Drainfields have a rule of their own: the wet-season water table has to sit at least 24 inches below the bottom of the drainfield, so a Navarre lot often needs a raised system on root-free, settled fill.
Termite pressure is the same everywhere in Northwest Florida. Native subterranean termites are statewide, and the Formosan termite is established across the state. A stump left under a Jay slab and a stump left under a Navarre slab feed the same colony.
What about permits and inspections around Jay, Milton and Pace?
Santa Rosa County’s residential permit checklist says clearing “is not permitted until after approval and issuance of the building permit,” with one shortcut: once plans pass zoning and flood review you can pay for a site permit and start clearing before the full building permit issues. The county also wants a letter from the termite company at submission stating the treatment type and chemical. Escambia County issues a Land and Tree Management Permit for clearing, grading and filling on a lot. Okaloosa County builds to the 2023 Florida Building Code and charges a $50 clearing permit on parcels without development plans.

What does grubbing cost compared with grinding?
Grinding runs about $150 to $300 per stump, with a national average near $250. Full removal runs $200 to $700, and pulling roots adds roughly $125 per root ball. Backfilling, compacting and density-testing a pad are priced per site, not per stump, because fill volume and haul distance set the number.
